2nd D. 1st Week Dec 6" 1904

 

    THIS DAY THIS CAUSE Coming on regularly for trial, came the Plaintiff by his Attorney, and announced ready, and the Defendant having been duly and legally served with process as required by law, came not nor answered herein, but wholly made default, and whereupon, a jury being waived, the Court after hearing the pleadings, the evidence and argument of Counsel, and duly considering the same, is of the opinion and so finds, that the material allegations in Plaintiff's Petition contained are true, and that the relief prayed for therein ought to be granted.

    It is therefore considered, ordered, adjusted and decreed by the Court, that the Bonds of Matrimony heretofore and now existing between the Plaintiff P. M. Garrett and the Defendant L. J. Garrett be, and the same are hereby forever dissolved and held for naught, and that they shall no longer bear towards each other the relationship of husband and wife.

Aud are held and firmly bound unto the Commonwealth of Kentucky, in the sum of fifty pounds, current money, the payment of which sum well and truly to be made, we bind ourselves, our heirs, executors and administrators, jointly and severally by these presents, sealed with our seals, and dated this 28th day of January 1833
    The condition of this obligation is that, Whereas, a marriage is shortly intended to be solemnized between the above bound Marshall Davison and Mary Avis
Now if there be no lawful cause to obstruct the said marriage, then this obligation to be void, else to remain in full force.

[This is interpreted to mean that Mary is Mary (Aud) Avis, the widow of ? Avis because her bondsman would have most likely been a blood relative - brother or father.  Also, four years earlier, a Mary Avis was baptizing a son without the father present.  The conclusion is that Mary Aud married ? Avis who died leaving her a son and that she later married M. Davison]
